Clausura Profepa construcción de Marina en Yucalpetén

MÉRIDA, Yucatán.- La Procuraduría Federal de Protección al Ambiente (PROFEPA) clausuró de manera total temporal la construcción de una marina en el Puerto de Abrigo de Yucalpeten, Progreso, Yucatán por la remoción de 1,300 m2 de vegetación, de los cuales 97 m2 corresponden a ecosistema Costero de Manglar y 1,203 m2 a matorral costero con la finalidad de llevar a cabo la construcción de una marina sin contar con la autorización correspondiente, emitida por la Autoridad Federal competente.
Durante la inspección realizada por personal de esta Procuraduría, se detectó que el área donde se realizaban actividades de eliminación de vegetación de humedal costero había presencia de especies de mangle botoncillo, negro y blanco.
Al carecer de los permisos correspondientes de la SEMARNAT, el personal de la PROFEPA procedió a clausurar el predio como medida de seguridad y determinó el cese de toda actividad en el sitio.
Cabe mencionar que el manglar es una especie listada en la NOM-059-SEMARNAT-2010 en la categoría de Amenazada (A), ya que está en peligro de desaparecer por distintas actividades que afectan a su hábitat o disminuyen directamente el tamaño de población de esta especie.
Según lo dispuesto por el artículo 171 de la Ley General del Equilibrio Ecológico y la Protección al Ambiente, el responsable de la obra puede hacerse acreedor a una multa por el equivalente de treinta a cincuenta mil días de salario mínimo general vigente en el Distrito Federal, y que asciende a una cantidad de más de 3 millones de pesos, así como la imposición de una clausura temporal o definitiva de la obra.
Adicionalmente a lo antes expuesto, las acciones de remoción y eliminado de relleno de humedal se encuentran en total contravención a lo dispuesto por el artículo 60 TER de la Ley General de Vida Silvestre, en estrecha relación con los puntos 4.6, 4.18 y 4.20 de la Norma Oficial Mexicana NOM-022-SEMARNAT-2003, tipificándose su conducta con lo señalado en la fracción I del artículo 122de la Ley antes referida.- (Boletín BP/602-15)

MERIDA, Yucatán.- The Federal Attorney for Environmental Protection (PROFEPA) total closed temporarily the construction of a marina at Port Shelter Yucalpeten, Progreso, Yucatan by removing 1,300 m2 of vegetation, of which 97 m2 correspond to Coastal mangrove ecosystem and coastal scrub to 1,203 m2 in order to carry out the construction of a marina without proper authorization, issued by the competent federal authority.
During the inspection conducted by staff of the Attorney General, it was detected that the area where disposal activities coastal wetland vegetation were made and had the presence of button mangrove species, black white.
Lacking the proper permits from SEMARNAT, PROFEPA personnel proceeded to close the premises for safety and determined the cessation of all activity on the site.
It is noteworthy that the mangrove is a species listed in NOM-059-SEMARNAT-2010 in the category of Endangered (A), because it is in danger of disappearing for various activities affecting their habitat or directly decrease the size of population this species.
As required by Article 171 of the General Law of Ecological Balance and Environmental Protection, responsible for the work you may be liable to a fine equivalent to 30 to 50,000 days of general minimum wage in the Federal District, and amounting to a total of over 3 million, and the imposition of a temporary or permanent closure of the work.
In addition to the above, removal actions and removed fill wetlands they are in total contravention of the provisions of Article 60 TER of the General Law of Wildlife closely with Sections 4.6, 4.18 and 4.20 of the Mexican Official Standard NOM-022-SEMARNAT-2003, it typified his behavior with the provisions of Section I of Article 122de before referida.- Act (Bulletin BP / 602-15)
