Así deslucía Mérida con las lámparas chinas puestas en la gestión de Angélica Araujo
Genera suspicacias un fallo contra la Comuna

Nicolás Madáhuar Boehm, presidente de Coparmex Mérida, consideró desafortunada la fecha elegida por el Tribunal de Justicia Fiscal y Administrativa de Yucatán para emitir su resolución sobre las lámparas chinas, pues esto genera suspicacia al coincidir con el último informe de gobierno del alcalde Renán Barrera Concha.
“Pareciera que el tribunal obedece a criterios políticos y no elementos legales”, expresó. “Reitero la palabra: pareciera. No puedo afirmar que así es”.
“Cuando menos no se erraría al plantear la hipótesis de que los tiempos fueron manejados políticamente…, eso es lo que se percibe”.
El dirigente fue integrante del comité ciudadano que vigiló el proceso de compra de las nuevas lámparas para sustituir las que instaló la empresa AB&C Leasing. Recordó que ese grupo no intervino en la decisión de la Comuna de cancelar el contrato con esa empresa y retirar las lámparas que instaló ésta.
También añadió que a ese grupo representativo de la sociedad le tocó procurar que la nueva compra de equipos fuera transparente: 1) En ese proceso hubo un concurso, 2) ganaron las mejores propuestas, 3) no se contrató a una sola empresa sino a varias de ellas, 4) se procuró que las nuevas luminarias cumplieran la Norma Oficial Mexicana, 5) se buscó que especialistas en el tema opinaran y participaran en esa tarea, 6) la sociedad vigiló esas acciones, y 7) no se dijo qué marca de lámparas comprar sino las especificaciones que debían tener éstas.
Entrevistado, declinó opinar sobre la resolución del tribunal ya citado, prefirió que eso lo hagan los abogados.
Por su parte, José López Campos, presidente de la Cámara de Comercio de Mérida, coincidió en que los puntos de vista legales sobre ese fallo judicial corresponden hacerlo a quienes conocen de leyes.

Sin embargo, señaló que el juicio todavía no concluye, “falta la última palabra”. “Este es sólo un paso más en el proceso para determinar quién tiene la razón”, añadió. “Este es un conflicto entre un particular y una autoridad, habrá que esperar el resultado final”.
El dirigente declinó comentar la coincidencia entre la emisión de la resolución del tribunal y el último informe del alcalde Renán Barrera. “No tengo elementos para opinar al respecto”.
Sobre los calificativos de “arrebato” y “soberbia” que los tres integrantes del tribunal citado pusieron en su resolución, el arquitecto López Campos dijo también que los abogados son los que deben opinar sobre ese punto. Pero consideró que los calificativos son secundarios, lo importante es el sentido del veredicto emitido.
Sobre el mismo tema el presidente estatal de la Canacintra, Mario Can Marín, expresó que la Comuna está en su derecho de llevar ese caso a la siguiente instancia para que sean las autoridades correspondientes las que emitan el fallo final.
“Lo importante en este tema es que la sociedad fue la que solicitó que se resolviera el problema del alumbrado público en Mérida, por lo cual se tomó una decisión para responder a esa petición y esto a su vez derivó en ese problema.
“Lo importante aquí es determinar qué estrategia tiene el actual Ayuntamiento, o el nuevo gobierno municipal que entrará en funciones el 1 de septiembre, en caso de que la Comuna pierda en la última instancia. Si no se tiene una estrategia al respecto entonces sería importante consultarlo con la sociedad y definir un plan de acción, establecer cómo se pagará (la cantidad que pide AB&C Leasing) en caso de perder este juicio.
“La ciudad no está para retroceder en los servicios públicos municipales que actualmente se ofrecen con eficiencia. El Ayuntamiento conocía esa contingencia, sabía que podía ganar o perder este juicio. Y quizá debió haber planteado una estrategia o una reserva de dinero para hacer frente a esa situación, la cual sí impacta en forma importante a la próxima administración municipal”.
En cuanto a la fecha en que el tribunal dio a conocer su fallo, Mario Can dijo que todo proceso judicial tiene sus tiempos y fechas, pero considera que “deja cierta molestia” esa casualidad. Esto se pudo omitir anunciando la resolución antes o después del informe de Renán Barrera.

Interviewed, she declined to comment on the decision of the aforementioned tribunal, preferring that lawyers do.
For his part, Jose Lopez Campos, president of the Chamber of Commerce of Merida, agreed that legal view points on that verdict are doing who know the law.
Canacome position
However, he noted that the trial has not yet concluded, "lack the last word". "This is just another step in the process to determine who is right," he added. "This is a conflict between an individual and an authority must await the end result."
The official declined to comment on the agreement between the issuance of the court's decision and the latest report of the mayor Renan Barrera. "I have no elements to say about it."

"The important thing here is to determine which strategy is the current City Hall, or the new municipal government that will take office on September 1, in the event that the Commune lost in the final. If you do not have a strategy about it then it would be important to consult with society and define an action plan to establish how (the amount requested Leasing AB & C) if you lose this trial will be paid.

As for the date when the court issued its ruling, he said Mario Can legal process has its times and dates, but believes that "leaves some discomfort" that chance. This could skip announcing the resolution before or after the report Renan Barrera.
